To ascertain tax incentives for multiple investment projects, businesses need to take note of the following:
Legal Basis: Decree No. 12/2015/ND-CP dated February 27, 2015, provides detailed regulations for implementing amendments to laws, supplements to certain provisions of laws, and amendments to, supplements to certain decrees on taxes.
According to the General Department of Taxation, in cases where a business has multiple investment projects, if the subsequent projects are new, independent of each other, and independent of the initial project while meeting the conditions for tax incentives in terms of sector and geographical area for corporate income tax (CIT), then the subsequent projects are entitled to CIT incentives for new investment projects.
In cases where subsequent projects are investment projects for expanding existing projects within sectors and geographical areas eligible for CIT incentives, meeting one of the three criteria for expansion investment as regulated, then the subsequent projects are entitled to CIT incentives under the expansion investment category.
In cases where a business has investment projects in the field of solar energy production, or wind energy production, subject to specific regulations and characteristics of the industry, the projects mentioned must comply with relevant sector-specific legal provisions.
